What is 5558?
Form 5558, Application for Extension of Time to File Certain Employee Plan Returns, is used to request a one-time extension of the deadline for Form 5500, Form 5500-SF, Form 5500-EZ, and Form 8955-SSA. A timely filed Form 5558 generally extends the due date by two and a half months.
The extension applies per plan, so a sponsor with multiple plans files a separate application for each. Note that Form 5558 is no longer used to request an extension for Form 5330; see the Form 5330 instructions for its current extension procedure.
Who files 5558?
- Plan administrators or sponsors who need more time to file a Form 5500 series annual return
- Sponsors of one-participant plans extending a Form 5500-EZ deadline
- Administrators extending the Form 8955-SSA registration statement for separated participants
- Anyone filing before the normal due date of the return they want to extend, which is required for the extension to be valid
