What is 8316?

Form 8316, Information Regarding Request for Refund of Social Security Tax Erroneously Withheld on Wages Received by a Nonresident Alien on an F, J, or M Type Visa, is a short questionnaire that accompanies a refund claim on Form 843. Certain nonresident students and exchange visitors are exempt from Social Security and Medicare tax, and this form documents why the withholding was wrong and what you did to fix it with your employer first.

The IRS expects you to ask the employer for a refund before filing a claim. Form 8316 asks whether you contacted the employer, whether the employer refunded any of the tax or will adjust it, and confirms your visa status during the period. It is filed with Form 843 and supporting documents such as your W-2 and visa records.
