What is 8966?
Form 8966, FATCA Report, is filed under the Foreign Account Tax Compliance Act to report specified U.S. accounts, substantial U.S. owners of passive non-financial foreign entities, and certain other accounts and payees. What must be reported depends on the filer’s chapter 4 status, such as participating foreign financial institution, registered deemed-compliant FFI, or withholding agent.
The form identifies the filer, the account holder or owner, and the account balance and income amounts for the year. Most financial institutions file it electronically through the IRS International Data Exchange Service (IDES) as XML rather than on paper, and institutions in Model 1 IGA jurisdictions generally report to their own tax authority instead.
Who files 8966?
- Participating and registered deemed-compliant foreign financial institutions reporting U.S. accounts
- Withholding agents reporting substantial U.S. owners of passive NFFEs
- Sponsoring entities and trustees of trustee-documented trusts filing for the entities they sponsor
- Territory financial institutions and other filers listed in the chapter 4 rules
How to fill out 8966
- Identify the filer in Part I, including the GIIN and chapter 4 status.
- Complete Part II with the account holder or payee information, or Part III for owner details when reporting an owner-documented FFI or passive NFFE.
- Report the account number, balance or value, and the income amounts required for your filer category in Part IV.
- Complete a separate report for each account or owner being reported.
- Download the finished PDF for your records; most filers must transmit the data electronically through IDES, so check the current instructions for whether paper filing is allowed in your case.

Do I file Form 8966 on paper or electronically?
Financial institutions generally must file electronically through the IRS International Data Exchange Service (IDES) in the FATCA XML format. Paper filing is limited to certain filers with an approved hardship waiver; check the current instructions.
Is this the same as FBAR or Form 8938?
No. Form 8966 is filed by institutions and withholding agents about their account holders. Individuals report their own foreign accounts on the FBAR (FinCEN Form 114) and, when required, Form 8938 with their tax return.
What if my institution is in an IGA country?
Institutions in Model 1 IGA jurisdictions generally report account information to their local tax authority, which exchanges it with the IRS, instead of filing Form 8966 directly. Model 2 institutions report to the IRS directly.
