What is 8992?

Form 8992, U.S. Shareholder Calculation of Global Intangible Low-Taxed Income (GILTI), computes the income inclusion that U.S. shareholders of controlled foreign corporations (CFCs) must report under section 951A. It nets tested income and tested losses across all of the shareholder’s CFCs and reduces the result by the deemed return on tangible assets.

The one-page form summarizes amounts that come from its Schedule A, where each CFC’s pro rata tested items are listed, and members of consolidated groups use Schedule B. The underlying CFC data generally comes from Form 5471 reporting.

  • U.S. shareholders that own 10 percent or more of one or more controlled foreign corporations
  • Domestic corporations with CFCs that have net tested income for the year
  • Individuals treated as U.S. shareholders of CFCs, including those making a section 962 election
  • Members of consolidated groups computing a group GILTI inclusion on Schedule B

How to fill out 8992

  1. Enter the U.S. shareholder’s name and identifying number at the top of the form.
  2. Complete Schedule A first, listing each CFC and its pro rata share of tested income, tested loss, and qualified business asset investment.
  3. Carry the Schedule A totals to Part I to figure net CFC tested income.
  4. Complete Part II to compute net deemed tangible income return and the final GILTI inclusion.
  5. Download the finished PDF and attach it, with Schedule A, to your income tax return.

Frequently asked questions

Do I still file Form 8992 if my CFCs have an overall tested loss?

If net CFC tested income is zero or less there is no GILTI inclusion, and in many cases the form is not required. The instructions explain when a filing is still needed, so check them for your situation.

How does Form 8992 relate to Form 5471?

Form 5471 and its Schedule I-1 report each CFC’s tested income, tested loss, and QBAI. Those amounts feed into Form 8992, which aggregates them at the shareholder level to compute the GILTI inclusion.
