What is ABSD Housing Developer Undertaking (4 or fewer units)?

When a developer acquires a residential site, Additional Buyer’s Stamp Duty applies. Remission can be claimed where the site is developed and the resulting homes are sold within set deadlines. This letter is the written undertaking required for that remission, given under rule 3(2)(e) of the Stamp Duties (Non-Licensed Housing Developers) (Remission of ABSD) Rules 2015.

A director signs on behalf of the company and promises to commence housing development on the site within two years of the Transaction Date, and to complete the development of four or fewer units and sell all of them within three years of the Transaction Date. The Transaction Date is the date of the contract or agreement to purchase the site, or the Transfer, whichever is earlier, or the date of a Collective Sale Order where that applies.

The undertaking commits the company to pay the Commissioner an amount equal to the ABSD remitted, as a debt due to the Singapore Government, together with interest at 5 percent per annum running from 14 days after the Transaction Date. Payment is due within one month of the Commissioner serving notice.

Which undertaking do I use for a larger development?

Use the letter of undertaking for developments of five or more units instead. It runs on a longer timeline and has a different clawback calculation tied to the proportion of units sold.

What counts as proof of commencement?

The letter lists the Written Permission issued by URA, the permit to commence structural works from the Building and Construction Authority, and a declaration from an architect or professional engineer stating the date piling, foundation or demolition works began.
