What is I-526E?

Form I-526E, Immigrant Petition by Regional Center Investor, is the petition an EB-5 investor files when the investment is made through a new commercial enterprise associated with a USCIS-designated regional center. It was introduced under the EB-5 Reform and Integrity Act of 2022, which split the old Form I-526 into two versions: I-526 for standalone investors and I-526E for regional center investors.

The petition asks USCIS to classify you as an employment-based fifth preference immigrant. You document the lawful source of your invested funds, the investment itself, and how the project is expected to create the required jobs. The regional center must have filed Form I-956F for the project before you can file. The required investment amount depends on whether the project is in a targeted employment area or qualifies as an infrastructure project; check the current thresholds at uscis.gov.

Who files I-526E?

  • Foreign investors seeking an EB-5 immigrant visa through a regional center-sponsored project
  • Investors whose funds are pooled into a new commercial enterprise covered by an approved or pending Form I-956F
  • Investors documenting a qualifying investment in a targeted employment area or standard-threshold project
  • Each investor files their own petition, even when many investors back the same project

Frequently asked questions

What is the difference between Form I-526 and Form I-526E?

Form I-526 is for standalone EB-5 investors who invest directly in their own new commercial enterprise. Form I-526E is for investors who invest through a project sponsored by a USCIS-designated regional center. The regional center route lets you count indirect and induced jobs toward the job creation requirement.

Can I file Form I-526E before the regional center files Form I-956F?

No. The regional center must have filed Form I-956F for the specific project before your I-526E can be filed. Your petition references that I-956F receipt number.

What happens after Form I-526E is approved?

You apply for an immigrant visa at a US consulate or, if eligible and in the United States, file Form I-485 to adjust status. You receive conditional permanent residence and later file Form I-829 to remove the conditions once the investment and job creation requirements are met.
