Form N244: Application notice
Form N244 is the general application notice used in the civil courts of England and Wales. You use it to ask a judge to make an order in an existing case, for example to set aside a judgment or to stop enforcement action.

What is N244?
The N244 asks what order you want, why you want it, and whether you are asking for it to be dealt with at a hearing, at a telephone hearing or without a hearing. You can set out the evidence in the form itself and sign a statement of truth, or attach a witness statement. If you want the application dealt with urgently, you say so and explain why.
Common uses include applying to set aside a default judgment, asking to vary the instalments on a judgment debt, applying to stay a warrant of control, asking for more time to comply with an order, or seeking relief from sanctions. Some courts and situations need a different or additional form, including the Commercial Court and the Chancery Division Financial List, and applications about funds held in court.

How to fill out N244
- Identify the claim number and the court dealing with the case; both go at the top of the form.
- State precisely what order you want the court to make and the legal or factual reason for it. Vague applications get refused.
- Set out your evidence in the box provided and sign the statement of truth, or attach a witness statement and exhibit any documents.
- Say whether you want a hearing, a telephone hearing or a decision on the papers, and give a realistic time estimate.
- File the application at the court handling the claim, with the fee, and serve a copy on the other party. Contact your local court if you are unsure where to send it.

Can I use N244 to set aside a county court judgment?
Yes, that is one of its main uses. You will need to explain why the judgment should be set aside, for example that you never received the claim form, and act promptly once you find out about it.
Will the application stop bailiff action?
Filing an application does not automatically stop enforcement. You have to ask the court for a stay or suspension as part of the application, and the court decides whether to grant it.
