What is I-821?

Form I-821 is used both for initial TPS registration and for re-registration during each extension period. TPS lets eligible nationals of a designated country remain in the United States, avoid removal, and obtain employment authorization while their country’s designation is in effect.

Eligibility depends on your nationality, your continuous residence and physical presence in the United States since the dates set for your country, and admissibility rules. Each country’s designation has its own registration windows, so timing matters.

Who files I-821?

Nationals of a country currently designated for TPS (or people without nationality who last habitually resided there)
First-time applicants registering during their country’s initial registration period
Current TPS holders re-registering during each announced re-registration window
Applicants also requesting a work permit, which is filed on Form I-765 with the TPS application

How to fill out I-821

Check uscis.gov to confirm your country is designated and that you are inside the registration or re-registration window.
Complete the form with your nationality, entry information, and the dates showing continuous residence and physical presence.
Gather identity and nationality evidence plus documents proving when you arrived and that you have remained in the United States.
Add Form I-765 if you want an employment authorization document, and include fees or a fee waiver request per the current instructions.
File online if your category supports it, or mail everything to the USCIS address listed for your country’s TPS designation.

Do I need to file Form I-821 again to keep TPS?

Yes. TPS holders must re-register during each re-registration period announced for their country. Missing a window without good cause can cost you the protection, so watch the Federal Register notices and uscis.gov announcements.

Can I get a work permit with TPS?

Yes. You can request an employment authorization document by filing Form I-765 together with your I-821 or afterward. The work permit lasts as long as allowed by your country’s current designation.

Does TPS lead to a green card?

TPS by itself is temporary and does not convert to permanent residence. Some TPS holders qualify for a green card through separate family or employment routes; that depends on individual circumstances.
