What is I-864EZ?

Like the full Form I-864, the I-864EZ is a legally enforceable contract in which a sponsor promises the US government to maintain the sponsored immigrant at the required income level so the immigrant does not become a public charge. It supports family-based green card cases at either a US consulate or through adjustment of status.

Only some sponsors qualify to use the simplified version: you must be the person who filed the visa petition, be sponsoring only the one relative named on that petition (no derivatives), and be able to prove your income using only your own salary or pension as shown on W-2 forms. Sponsors who need to count assets, household member income, or self-employment income must use the full Form I-864 instead.

Who files I-864EZ?

Petitioners who filed Form I-130 for exactly one relative, with no derivative spouse or children immigrating
Sponsors whose qualifying income is entirely from salary or pension reported on W-2 forms
US citizens or permanent residents, at least 18 years old, domiciled in the United States
Sponsors who meet the income requirement alone, without household members or joint sponsors

How to fill out I-864EZ

Answer the eligibility questions at the start of the form; if any answer disqualifies you, switch to the full Form I-864.
Complete your biographic information and details about the one relative you are sponsoring.
Report your current income and attach your most recent federal tax return or transcript along with the supporting W-2s.
Compare your income to the current Federal Poverty Guidelines on Form I-864P to confirm you qualify on your own.
Sign the affidavit and include it in the immigrant’s consular processing package for the National Visa Center or the adjustment of status filing with USCIS.

Who can use Form I-864EZ instead of Form I-864?

Only the petitioner, sponsoring the single relative named on the petition, using income proven entirely by W-2 salary or pension. If children are immigrating with your relative, if you are self-employed, or if you need assets or another person’s income, use the full I-864.

How long does the support obligation last?

Until the immigrant becomes a US citizen, is credited with 40 qualifying quarters of work, permanently leaves the United States, or dies. Divorce does not end the obligation.
