What is I-865?
Anyone who signed Form I-864, I-864A, or I-864EZ takes on a continuing legal duty to keep USCIS informed of their address until the support obligation ends. Form I-865 is the notice used to satisfy that duty, and it must be filed within 30 days of each move.
This filing is separate from Form AR-11, the general alien change of address notice. A sponsor who is also a non-citizen may need to file both. Failing to file Form I-865 when required can result in civil fines, with higher penalties if the sponsor knew the sponsored immigrant had received means-tested public benefits.
Who files I-865?
- Sponsors who signed Form I-864 or I-864EZ and have moved to a new address
- Household members who signed Form I-864A and have moved
- Joint sponsors and substitute sponsors with an active support obligation
- Any of the above, every time they move, until the support obligation ends
How to fill out I-865
- Fill in your name, the address you are moving from, and your complete new address.
- Identify the sponsored immigrant or immigrants connected to your affidavit of support.
- Sign and date the notice.
- Mail it to the USCIS address listed in the current form instructions within 30 days of your move.
- Keep a copy and proof of mailing, since the 30-day deadline is set by statute.
