Every US employer completes a Form I-9 for every new hire: the employee attests to work authorization, the employer examines documents proving it. Nothing is mailed anywhere; the form lives in the employer’s files.

What is I-9?

Form I-9 verifies identity and employment authorization. Section 1 is the employee’s attestation, completed no later than the first day of work. Section 2 is the employer’s: within three business days, examine original documents from the form’s Lists (a passport alone, or a List B identity document plus a List C work authorization document) and record them.

Employers keep the form for three years after hire or one year after employment ends, whichever is later, and produce it on government inspection. Supplement B covers rehires and reverification.

Who files I-9?

  • Every employee hired in the United States, citizen or not
  • Every employer, for each employee, no matter how small the business
  • Not needed for true independent contractors or unpaid volunteers

How to fill out I-9

  1. Employee: complete Section 1 by your first day, attesting to your citizenship or authorization status.
  2. Employee: present original documents from the acceptable documents lists.
  3. Employer: examine the documents within three business days and record them in Section 2.
  4. Employer: sign, then retain the form and any copies of documents in your I-9 file for inspection, not for mailing.

Frequently asked questions

Which documents can an employee show?

One List A document (US passport, green card, or EAD with photo) proves both identity and authorization. Otherwise one List B identity document (driver’s license) plus one List C work authorization document (Social Security card without restrictions, birth certificate).

Does the I-9 get sent to USCIS?

No. It stays with the employer, available for inspection by ICE, DOL, or DOJ. E-Verify is a separate, partly voluntary electronic check.

Can the I-9 be completed remotely?

Employers enrolled in E-Verify in good standing can use the authorized alternative procedure with a live video examination; other employers must inspect documents physically.
