What is ETS (s72)?
Section 72 of the Women's Charter lets the court change a maintenance order that is already in place. The form explains the three outcomes in its own words: variation changes part of the order, for example reducing monthly maintenance; suspension postpones payments to a later date while the amounts still accumulate; and rescission stops the maintenance required by the order altogether.
The 16 page statement mirrors the fresh application form but asks you to compare then and now. Parts D1 to D3 set your income, assets, debts and liabilities at the time the order was made against your position today, and the form asks for proof of a material change in circumstances or other good cause, plus a copy of the relevant court order. Supporting documents are uploaded on iFAMS under the labels the form gives for each part.
Who files ETS (s72)?
- A person paying maintenance who wants the amount reduced, postponed or stopped after a change in circumstances
- A person receiving maintenance who wants the order increased or otherwise varied
- Complainants whose employment, income or health has changed materially since the order was made
- Anyone asked by the Family Justice Courts to file the section 72 statement before mediation or a hearing
How to fill out ETS (s72)
- Read the explanatory notes on page 1 and decide whether you are asking to vary, suspend or rescind the order.
- Complete Part A with your personal particulars and the email address the court will use, then Part B with the marriage and children details.
- Attach the relevant court order and set out the material change in circumstances or other good cause you rely on.
- Complete Parts D1 to D3 twice over, showing your income, assets, debts and liabilities when the order was made and now, with payslips, CPF statements and IRAS Notices of Assessment as proof.
- File the statement and upload the supporting documents through iFAMS for the Family Justice Courts, using the document labels printed in each part.

Frequently asked questions
What counts as a material change in circumstances?
The form does not fix a list. It asks for proof, and the sections it sets out point to the things that usually matter: a change of employment or employment status, a fall or rise in income, new debts, new assets, or a change in the needs of the children. Document whatever you rely on.
Does suspension wipe out the missed payments?
No. The form states that under suspension the amounts not paid still accumulate and remain payable. Only rescission stops the maintenance required by the order.
Do arrears get dealt with in the same application?
Enforcement of unpaid maintenance is a separate process from varying the order. If money is owed as well as the order needing to change, ask the Family Justice Courts which applications you need to file.
