What is I-129F?

Form I-129F establishes the qualifying relationship for the K-1 fiance(e) visa. The U.S. citizen petitioner must show that both partners are legally free to marry, that they intend to marry within 90 days of the fiance(e)'s admission, and, in general, that they have met in person within the two years before filing unless an exception applies. The fiance(e)'s unmarried children under 21 can be included for K-2 visas.

The form is also used in some cases for the K-3 spouse classification. After USCIS approves the petition, it goes to the Department of State: the National Visa Center forwards it to the U.S. embassy or consulate where the fiance(e) applies for the visa and attends an interview. Once admitted, the couple must marry within 90 days, after which the foreign spouse typically applies for adjustment of status with Form I-485.

Confirm eligibility: only U.S. citizens can file, both partners must be free to marry, and the in-person meeting requirement must be met or exempted.
Complete the form for the petitioner and beneficiary, including the required criminal history disclosures.
Gather evidence of citizenship, the genuine relationship, the in-person meeting, and intent to marry within 90 days.
Pay the current filing fee listed at uscis.gov/fees and sign the petition.
Mail the package to the USCIS lockbox address listed for Form I-129F; after approval, the case moves to the National Visa Center and then the consulate for the visa interview.

Can a green card holder file Form I-129F?

No. Only U.S. citizens can petition for a K-1 fiance(e). A lawful permanent resident who wants to sponsor a partner marries first and files Form I-130 for the spouse.

What happens if we do not marry within 90 days?

K-1 status cannot be extended and the fiance(e) is expected to depart. Marrying someone other than the petitioner does not cure the status. If you marry the petitioner within the 90 days, the next step is usually adjustment of status on Form I-485.

Do we have to have met in person?

Generally yes, within the two years before filing. USCIS can waive the requirement if meeting would violate strict cultural or religious customs or cause extreme hardship, but waivers need strong evidence.
