What is I-140?

Form I-140, Immigrant Petition for Alien Workers, is filed with USCIS to classify a foreign worker in an employment-based immigrant category: EB-1 for priority workers, EB-2 for advanced-degree professionals and exceptional ability, and EB-3 for skilled workers, professionals, and other workers. Most EB-2 and EB-3 petitions require an approved permanent labor certification (PERM) from the Department of Labor first.

An approved I-140 establishes the worker’s priority date and classification but does not by itself grant permanent residence. The worker later applies for a green card through adjustment of status (Form I-485) or consular processing once a visa number is available.

How to fill out I-140

Complete the petitioner information in Part 1 and identify the worker in Part 3.
Select the requested classification in Part 2, such as EB-1A, EB-2 NIW, or EB-3 skilled worker.
Describe the job offer, proposed wages, and the petitioner’s ability to pay, and attach the approved labor certification if the category requires one.
Attach the evidence for the classification: degrees, experience letters, publications, or ability-to-pay documents such as annual reports or tax returns.
Download the finished PDF, add the filing fee, and mail the package to the USCIS address listed for Form I-140, or file online if your category supports it. Premium processing is available with Form I-907.
