What is I-192?

Form I-192, Application for Advance Permission to Enter as a Nonimmigrant, is the application for a discretionary waiver under section 212(d)(3) of the Immigration and Nationality Act. It lets a person who is inadmissible, for example because of a past criminal conviction or immigration violation, ask for permission to enter the United States temporarily as a nonimmigrant.

Where it is filed depends on who is applying. Applicants for T or U nonimmigrant status file it with USCIS along with their underlying application. Most other applicants, such as visa-exempt Canadian citizens, apply through U.S. Customs and Border Protection, which accepts electronic filings and decides the waiver through its Admissibility Review Office.

Visa-exempt travelers, such as Canadian citizens, who are inadmissible and want to visit the United States
Applicants for T nonimmigrant status (trafficking victims) who need a waiver of inadmissibility
Applicants for U nonimmigrant status (crime victims) who need a waiver of inadmissibility
Other nonimmigrants directed by CBP or a consulate to request advance permission to enter

Frequently asked questions

How long does an approved I-192 waiver last?

Waivers are granted at the government’s discretion for a set validity period, commonly up to a few years. The approval notice states the period. Reapply before it expires if you still need to travel.

Do I file the I-192 with USCIS or CBP?

T and U visa applicants file with USCIS together with their underlying petition. Most other applicants, including visa-exempt Canadians, file through CBP. Check the current filing instructions before submitting.

Does an approved waiver make me admissible permanently?

No. It only waives inadmissibility for temporary nonimmigrant entry during its validity period. It does not fix inadmissibility for a green card, which needs a different waiver such as Form I-601.
