What is I-817?

Form I-817 is the application for the Family Unity Program, created for close family members of immigrants who legalized under the Immigration Reform and Control Act of 1986 or under the LIFE Act. Approved applicants receive protection from removal for a set period and may apply for employment authorization.

Eligibility generally turns on your relationship to the legalized family member and your presence in the United States by the dates set in the law. The form is also used to request an extension of previously granted Family Unity benefits.

Spouses of immigrants who obtained lawful status through IRCA legalization or LIFE Act legalization
Unmarried children of those legalized immigrants who meet the entry date and age rules in the instructions

How to fill out I-817

Read the eligibility criteria in the instructions and confirm which program category applies to you.
Complete the biographic sections and the details of your qualifying relative’s legalization.
Attach proof of the family relationship, proof of your qualifying relative’s status, and evidence of your presence in the United States.
Sign the form and include the fee amount shown on uscis.gov, or a fee waiver request if you qualify.
Mail the application to the USCIS address listed in the current form instructions.
