What is N7?

The N7 is a Landlord and Tenant Board notice of termination for the most serious grounds under the Residential Tenancies Act. It applies where a tenant or their guest has seriously impaired the safety of another person, wilfully or negligently caused significant damage, used the unit or complex in a way that is inconsistent with its use as residential premises and caused significant damage, or, in a building with three or fewer units where the landlord lives, substantially interfered with the landlord’s reasonable enjoyment.

Because the grounds are serious, the notice period is short: the termination date is generally at least 10 days after the notice is given, and unlike some other notices the tenant usually cannot void an N7 by correcting the behaviour. How to fill out N7

  1. Open the downloaded N7 in Adobe Acrobat Reader, since the dynamic PDF will not fill in a browser.
  2. Enter the tenant and landlord details and the address of the rental unit.
  3. Select the ground that applies and describe, in detail, the specific events, dates and conduct that support it.
  4. Enter a termination date that is at least 10 days after the notice is given, then sign and date the notice.
  5. Serve the N7 on the tenant. If the tenant does not move out, apply to the Landlord and Tenant Board using form L2 for a hearing and an eviction order.
Worth knowing: The N7 covers only the serious grounds listed on the form. For interference, damage or overcrowding that is less serious, a different notice such as the N5 applies. The tenant usually cannot void an N7, but the Board still decides eviction after a hearing.

Frequently asked questions

Can the tenant fix the problem to cancel an N7?

Generally no. Unlike notices for lesser issues, an N7 does not usually give the tenant a chance to void it by stopping the behaviour. The Landlord and Tenant Board weighs the evidence at a hearing before deciding whether to order eviction.

How much detail does the N7 need?

A lot. The notice must describe the specific conduct, with dates and details, so the tenant knows the case to meet. Vague allegations can lead the Board to find the notice invalid.
