What is N8?
The N8 is a Landlord and Tenant Board notice of termination used at the end of a fixed term or rental period under the Residential Tenancies Act. The grounds include persistent late payment of rent, the tenant no longer qualifying for subsidised or special purpose housing, the rental unit being part of an institution providing care where the tenant no longer needs that level of care, and certain situations where the tenancy was created for employment that has ended.
The termination date must be at least 60 days after the notice is given and must be the last day of a fixed term or, for a periodic tenancy, the last day of a rental period. What counts as persistent late payment?
There is no fixed number, but a pattern of consistently paying rent after it is due can support an N8. The Landlord and Tenant Board looks at the history at a hearing and decides whether the pattern justifies ending the tenancy.
Does the tenant have to leave on the termination date?
Not automatically. The N8 sets the date the landlord wants the tenancy to end, but only the Landlord and Tenant Board can order eviction if the tenant stays and disputes the notice.
