What is N/A?
The application is used in criminal cases before the State Courts of Singapore when a party needs a witness to attend court and that attendance cannot simply be arranged between them. The court, not the applicant, decides whether to issue the summons.
The single page form has three parts. Part A takes the applicant's name, NRIC, address and contact numbers. Part B takes the case number, the charges (MSC, MCN, DCN or DAC), the names of the complainant and the defendant or respondent, and the date and time of the hearing. Part C names the witness, gives their address, states whether they are called for the defence or the prosecution, and explains the relevance of the witness to the case. Where the hearing is within the next 7 days, the applicant also confirms that the witness has been told about the hearing and is willing to attend if summoned.

- In Part C, state whether the witness is for the defence or the prosecution, give the witness's full name and address, and explain why their evidence is relevant to the case.
- If the hearing falls within the next 7 days, tick the confirmation that you have told the witness about the hearing and that they are willing to attend if summoned.
- Sign and date the application, then file it with the State Courts registry dealing with your case. The court decides whether to issue the summons and will give directions on service.

No. The application asks the court to issue a summons. The court weighs the relevance of the proposed evidence, which is why Part C asks you to explain how the witness relates to the case.
Do I have to tell the witness first?
The form only requires that confirmation where the hearing is scheduled within the next 7 days of the application. Even then, telling the witness early is sensible so the hearing is not delayed.
