What is VA Form 26-6381?
VA loans can be assumable: a buyer takes over the seller's existing mortgage at its current rate instead of getting a new loan. For loans that require approval, the servicer or VA must find the new borrower creditworthy before the transfer. Without an approved assumption and release, the original veteran can remain personally liable to the government if the loan later defaults.
This application collects the proposed transfer details and the new borrower's financial information so the assumption can be underwritten. A related but separate issue is entitlement: the seller's VA entitlement generally stays tied up in the loan unless the assuming buyer is an eligible veteran who substitutes their own entitlement.
Who files VA Form 26-6381?
- Veterans selling a home whose buyer wants to assume the existing VA loan
- Buyers, veteran or not, applying to assume a VA-guaranteed mortgage
- Veterans seeking release from personal liability after transferring a property with a VA loan
- Divorcing spouses arranging for one party to assume the VA loan on the family home
How to fill out VA Form 26-6381
- Contact the loan servicer first; many servicers process VA assumptions themselves under automatic authority.
- Complete the sections identifying the loan, the current borrower, and the proposed new borrower.
- Provide the new borrower's income, employment, and obligation details so creditworthiness can be reviewed.
- Sign and date the application, with both transferor and transferee signing where indicated.
- Submit it to the loan servicer, or to the VA Regional Loan Center handling the loan if the servicer does not have approval authority; keep the written approval and release with your records.

Frequently asked questions
Why do I need a release of liability?
If someone assumes your VA loan without an approved release, you can stay personally liable to the government if the loan defaults, even years after you sold the home. The approved assumption and release cuts that tie.
Does an assumption free up my VA entitlement?
Not by itself. Your entitlement stays committed to the loan unless the assuming buyer is an eligible veteran who formally substitutes their own entitlement. Otherwise you may have reduced entitlement for a future VA loan until that loan is paid off.
Can a non-veteran assume a VA loan?
Yes, if the servicer or VA approves them as creditworthy. The loan keeps its VA guaranty, but a non-veteran buyer cannot substitute entitlement, so the seller's entitlement remains tied to the loan.
