What is Security Bond (Regulation 12)?

The form is issued under the Employment of Foreign Manpower Act and Regulation 12 of the Employment of Foreign Manpower (Work Passes) Regulations. By signing it, the company acknowledges itself bound to pay the Government of the Republic of Singapore SGD$5,000 per work pass holder, or such sums as the Controller of Work Passes may specify from time to time.

It sets out the conditions the employer must observe: prompt payment of salary, upkeep and maintenance including medical treatment, acceptable accommodation, bearing the full cost of repatriation, producing a worker to the Controller when required, employing workers in line with their Work Pass and Regulatory Conditions, and informing the Controller in writing within seven days of any completion, termination or resignation. Breaching any of them puts the obligation into force and the amount shown in the Letter of Guarantee can be forfeited in part or in whole. The form is marked to be signed once only, and the obligation stays in force as long as the Letter of Guarantee is valid.

How to fill out Security Bond (Regulation 12)

  1. Enter the company name, Unique Entity Number and registered office address in the opening paragraph.
  2. Read the seven conditions and the forfeiture clause, because signing accepts them for every worker named in the Letters of Guarantee.
  3. Arrange the security bond with a bank or insurer, quoting the MOM template they must use and naming the Ministry of Manpower as beneficiary.
  4. Have the form signed by a director registered with ACRA, or by the sole proprietor or partner, with the company seal or a witness where there is no seal.
  5. Submit the signed form to the Work Pass Division, Ministry of Manpower, 18 Havelock Road, Singapore 059764.
Worth knowing: The security bond is the employer's cost and must not be recovered from the worker. It is signed once at company level and works alongside the Letter of Guarantee from your bank or insurer.
