What is I-589?

Form I-589, Application for Asylum and for Withholding of Removal, is filed by people physically present in the United States who fear persecution in their home country on account of race, religion, nationality, membership in a particular social group, or political opinion. The same form also requests withholding of removal and can raise protection under the Convention Against Torture.

You must generally file within one year of your last arrival in the United States, unless you qualify for an exception based on changed or extraordinary circumstances. A spouse and unmarried children under 21 who are in the United States can be included on the application. Where you file depends on your situation: applicants not in removal proceedings file with USCIS, while people in proceedings file with the immigration court (EOIR).

How to fill out I-589

Complete your identity, family, and background information in Parts A.I through A.III.
Answer the questions in Part B about why you are applying, and describe the harm you suffered or fear in detail.
Complete the supplementary questions in Part C and explain any late filing in Part D if you are past the one-year deadline.
Attach your written declaration, country condition evidence, and copies of identity documents, with certified translations for anything not in English.
Download the finished PDF and sign it. File with USCIS by mail or online if eligible, or with the immigration court handling your case if you are in removal proceedings.

Frequently asked questions

What is the one-year deadline for Form I-589?

You must generally file within one year of your last arrival in the United States. Exceptions exist for changed circumstances that affect your eligibility or extraordinary circumstances that caused the delay, but you must explain and document them.

Can I work while my asylum application is pending?

Not immediately. You can apply for an employment authorization document on Form I-765 after your I-589 has been pending for the waiting period set by regulation. Check the current rules at uscis.gov.

Do I file Form I-589 with USCIS or the immigration court?

If you are not in removal proceedings, you file with USCIS. If you are in proceedings before an immigration judge, you file the form with the court under EOIR procedures. The form is the same in both settings.
