What is I-751?

Form I-751, Petition to Remove Conditions on Residence, is filed by people who received a two-year conditional green card based on a marriage that was less than two years old when residence was granted. The petition asks USCIS to remove the conditions and issue a regular ten-year green card by showing the marriage was entered in good faith.

The standard route is a joint petition filed with your spouse during the 90-day window before the conditional card expires. If the marriage has ended in divorce, if you or your child were battered or subjected to extreme cruelty, or if removal would cause extreme hardship, you can request a waiver of the joint filing requirement and file alone. Failing to file on time can terminate your status, so the deadline matters. Complete the petition with your information, your spouse’s information for a joint filing, or the waiver basis if filing alone.
Gather evidence that the marriage is or was genuine: joint leases or mortgages, joint finances, insurance, children’s birth certificates, photos, and affidavits.
Include a copy of the front and back of your conditional green card and any documents the waiver basis requires.
