What is LP1H?
A health and care lasting power of attorney lets you appoint attorneys to make decisions about your daily care, medical treatment, and where you live, but only once you no longer have the mental capacity to decide for yourself. That is the key difference from the financial LPA on LP1F, which can be used earlier if you allow it.
The form includes a specific choice about life sustaining treatment: you say whether your attorneys can give or refuse consent to it on your behalf, or whether that decision stays with your doctors. As with LP1F, the same form makes and registers the LPA, and it has no legal effect until the Office of the Public Guardian has registered it.
Who files LP1H?
- Anyone aged 18 or over with mental capacity who wants to choose who speaks for them about care and treatment
- People with a progressive condition who want their wishes about treatment recorded now
- Attorneys registering a health and care LPA the donor has already signed
- Families making a health and care LPA alongside a financial LPA on LP1F
How to fill out LP1H
- Fill in the donor’s details and name the attorneys and any replacements.
- Choose how the attorneys must act together, and state your decision on life sustaining treatment.
- Add any preferences or instructions about care, treatment or where you would like to live.
- List the people to be told about the registration and notify them on form LP3, then sign in the order the form sets out with the certificate provider and attorneys.
- Download and print the completed PDF and send the signed original with the fee to the Office of the Public Guardian, PO Box 16185, Birmingham B2 2WH.

Only when the donor lacks the mental capacity to make the particular decision themselves. Until then, the donor decides.
What happens if I do not complete the life sustaining treatment section?
The form has to record a clear choice. Leaving it blank is one of the errors that leads the Office of the Public Guardian to reject an application, so read that page carefully before signing.
Do I need both LP1F and LP1H?
They are separate LPAs and many people make both. Each is registered separately, and a fee applies to each, so check the current fees on GOV.UK.
