LP3, Lasting power of attorney: form to notify people

What is LP3?

When you make a lasting power of attorney you can name people who should be told before it is registered. LP3 is the notice that goes to each of them. It tells them who the donor is, who the attorneys are, and that an application to register the LPA is being made.

The point of the notice is to give those people a chance to object. GOV.UK states they have 3 weeks to raise any concerns with the Office of the Public Guardian, for example if they believe the donor was pressured into making the LPA or does not have the mental capacity to make one. A separate copy of the form goes to each person named.

Who files LP3?

• Donors who named people to be told when they made an LP1F or LP1H
• Attorneys applying to register an LPA on the donor’s behalf
• Anyone completing the notification step before an LPA is sent to the Office of the Public Guardian
• Practitioners preparing an LPA registration pack for a client

How to fill out LP3

1. Fill in the donor’s name and address so the person receiving the notice knows whose LPA it is.
2. Enter the names and addresses of the attorneys and any replacement attorneys.
3. State whether the LPA covers property and financial affairs, health and care, or both.
4. Complete a separate copy of the form for each person named as a person to notify, and date each one.
5. Download and print the notices and send one to each person to notify. They then have 3 weeks to raise concerns with the Office of the Public Guardian before the LPA is submitted for registration.
