What is LPA120?
The Office of the Public Guardian charges a fee to register a lasting or enduring power of attorney, with a lower fee for a repeat application. LPA120 asks for that fee to be reduced or waived. It works on the donor’s circumstances, not the attorney’s, so it is the donor’s income and benefits that count.
There are two routes. Exemption means no fee at all and applies where the donor receives certain means tested benefits, which the form lists. Remission means a reduced fee and applies where the donor’s gross annual income is below the threshold set by the OPG. Donors receiving Universal Credit are assessed for remission rather than exemption. GOV.UK is clear that the application has to be made at the same time as the registration, because refunds are not given afterwards.

- Donors on a low income who are registering a lasting power of attorney
- Donors receiving qualifying means tested benefits who want the fee waived

How to fill out LPA120
- Enter the donor’s details and say which power of attorney the application relates to.
- Choose the exemption route if the donor receives one of the means tested benefits listed on the form, and tick which benefit.
- Choose the remission route if the donor is on a low income, and give the gross annual income figure.
- Attach the evidence the form asks for, such as a benefit award letter or proof of income, and sign the declaration.

Frequently asked questions
Can I apply after I have paid?
No. GOV.UK states that payment must be made at the time of applying to register the power of attorney and that retrospective refunds are not possible, so send LPA120 with the registration.
