What is N-600K?
Children living outside the United States generally do not derive citizenship automatically, even with a US citizen parent. Section 322 of the INA fills the gap: a US citizen parent, or in some circumstances a US citizen grandparent or legal guardian, applies on the child’s behalf with Form N-600K. The parent must show US physical presence of five years, at least two after age 14, or rely on a US citizen grandparent who meets that test.
The child must be under 18, reside abroad in the legal and physical custody of the citizen parent, and be lawfully admitted to the US temporarily to complete the process. Citizenship is granted when the application is approved and the child takes the oath, if required, before turning 18. Children of US service members stationed abroad have modified rules.

How to fill out N-600K

- Complete the application with the child’s information, your citizenship details, and the physical presence history.
- Gather evidence: the child’s birth certificate, proof of your citizenship, custody documents, and records establishing physical presence, such as school, tax, or employment records.
- File with the current fee per the N-600K instructions; check uscis.gov, and note the interview must be completed before the child turns 18.
- Bring the child to the US in lawful status for the scheduled interview and, if required, the oath; the certificate issues on approval.

What if we miss the age deadline?
All requirements, including approval and the oath, must be met before the child turns 18. After that, section 322 is no longer available and the person would need another path, such as immigrating and later naturalizing.
