What is TP1?

TP1 is the HM Land Registry transfer deed for a part transfer of registered land in England and Wales. Where the whole of one or more registered titles is being transferred, form TR1 is used instead. Because only part of the land moves, the form has to define exactly what is being transferred and deal with the rights, covenants and other arrangements that survive the split.

The panels cover the title number the property is transferred out of, any other titles affected, the property and the plan that identifies it, the date, the transferor and transferee (including company registered numbers and, for overseas entities, the overseas entity ID issued by Companies House), the addresses for service, the consideration, the title guarantee, any declaration of trust where there is more than one transferee, additional provisions such as new easements and covenants, and execution by the parties.

Who files TP1?

  • Owners selling part of a registered property, such as a plot or a section of garden
  • Developers transferring individual plots out of a larger registered site
  • Conveyancers preparing a part transfer deed for their client
  • Anyone imposing or reserving new rights and covenants over the land that is retained

How to fill out TP1

  1. Enter the title number the property is transferred out of, any other titles to be affected, and a description of the property with a plan showing the land, signed as the form requires.
  2. Give the full names of the transferor and the transferee, with company or LLP registered numbers, or the overseas entity ID issued by Companies House where that applies.
  3. Add the transferee's addresses for service, the consideration, and the title guarantee being given.
  4. Complete the declaration of trust where there is more than one transferee, and set out any easements, rights and covenants in the additional provisions panel.
  5. Execute the transfer as a deed, then send it to HM Land Registry with form AP1 (or FR1 for first registration), the plan, evidence of identity and the correct fee. Check the current fee on gov.uk.
Worth knowing: TP1 is a deed and it takes effect only when it has been executed correctly and registered. HM Land Registry recommends considering legal representation, and its practice guide 21 covers the more complex part transfers.

Frequently asked questions

When do I use TP1 rather than TR1?

Use TP1 when only part of the land in a registered title is being transferred. TR1 is for transferring the whole of one or more registered titles.

Do I have to attach a plan?

Yes. A part transfer must identify the land being transferred, and HM Land Registry expects a plan that meets its plans requirements. Any plan lodged must be signed as the form directs.

What if the land is mortgaged?

A mortgage over the whole title has to be dealt with. HM Land Registry points to a discharge of part, form DS3, where a charge affects the land being transferred. Take advice before completing.
