West Virginia requirements

• West Virginia DMV publishes its own vehicle bill of sale, form DMV-7-TR, and its form listing states that it is completed by both the buyer and the seller and must be notarized. Our general bill of sale is a general purpose alternative and is well suited to non vehicle property, but for a titled vehicle use or attach the state form and have it notarized.
• For a titled vehicle, the buyer applies for a West Virginia title on form DMV-1-TR, the Certificate of Title application, which West Virginia DMV describes as used for an out of state vehicle or any regular vehicle without a West Virginia title.
• Under W. Va. Code 17A-3-4 the title application must be signed and sworn to by the applicant, and knowingly swearing falsely on an affidavit required by that section is a criminal offense.
• When no previous title is available, West Virginia DMV uses the Owner and Purchaser Affidavit, form MB-12/13, which its form listing also states must be notarized.
• Odometer disclosure follows the federal rule and is normally captured on the assigned title. Record an accurate reading rather than an estimate.
• W. Va. Code 17A-3-4 does not set a general titling deadline for an in state private purchase, though a new resident must title and register within 30 days of establishing residency. Confirm the current deadline, fees and forms with the West Virginia Division of Motor Vehicles before you file.
